Abstract

<jats:p>The article provides a comprehensive theoretical and practical analysis of the legal procedure for dividing a land plot among co-owners under Ukrainian legislation. Based on the systematization of scholarly publications from 2020–2026, normative-legal acts, case law materials of the Supreme Court, and official statistical data of the State Service of Ukraine for Geodesy, Cartography and Cadastre, the main legal mechanisms for dividing land plots held in common shared and common joint ownership are elucidated. The aim of the study is to determine the legal procedure for dividing a land plot among co-owners, classify typical conflicts arising during such division, and formulate recommendations for practicing lawyers and land surveyors. The methodological basis of the study comprised theoretical analysis and synthesis of seventeen scholarly and normative sources, comparison of voluntary and judicial division procedures using a set of criteria, and classification of typical conflict situations by structural features. It is established that the division of a land plot among co-owners is a complex legal procedure requiring interaction among several institutions: notariate, land surveying organizations, the State Land Cadastre, and the State Register of Property Rights to Immovable Property. It is shown that M. S. Dolynska, M. V. Shulha, O. O. Hrekova, and other researchers substantiate the expediency of developing the institution of mediation as an alternative mechanism for resolving land disputes among co-owners. Based on the analysis conducted, a classification of six main types of conflicts arising during the division of land plots is proposed, and ways of their legal resolution are determined. The practical significance of the work is determined by the possibility of using comparative characteristics of division methods, the catalog of conflict situations, and the division procedure algorithm by practicing lawyers, notaries, certified land surveyor engineers, and local self-government bodies.</jats:p>
