Abstract

<jats:p>This article provides a comprehensive analysis of the legal and ethical aspects of the use of artificial intelligence (AI) technologies in psychological science within the context of the digital transformation of society. It is substantiated that the implementation of AI opens up new opportunities for improving diagnostics, predicting behavior, automating research processes, and enhancing the effectiveness of psychological assistance; however, it is simultaneously accompanied by a number of significant challenges. Among the key issues identified is the lack of a clear regulatory framework governing the application of AI in psychology, which leads to legal uncertainty and risks of misuse. Particular attention is paid to issues of personal data protection, confidentiality, and obtaining informed consent from research participants. It is emphasized that the use of machine learning algorithms involves the processing of sensitive information, thereby increasing the risks of unauthorized access and violations of human rights. The problem of legal liability for decisions made by AI systems is also examined, which is complicated by the absence of legal personality of AI and creates legal conflicts in cases of algorithmic errors. The article further analyzes the issue of algorithmic bias and discrimination, which may arise from the use of biased data and lead to distortions in the results of psychological diagnostics. The significance of international approaches to AI regulation is highlighted, particularly the provisions of the EU AI Act, as well as the recommendations of the American Psychological Association and UNESCO, which emphasize the need for transparency, accountability, and the preservation of human oversight. It is established that the national legislation of Ukraine only partially regulates this area and requires further harmonization with international standards. The study concludes that there is a need to develop specialized legal norms governing the use of AI in psychological research, ensuring a balance between technological advancement and the protection of human rights. It is emphasized that the integration of AI into psychology should be carried out in accordance with humanistic principles, where the individual, their dignity, and safety remain central.</jats:p>
