Abstract
Abstract
Digital constitutionalist theorists propose a framework to analyse and potentially resolve power struggles in the digital age, particularly—although not exclusively—power struggles over content management. The concept is proposed as both a historical moment and a theoretical framework and has been developed mainly in Europe. The model could have potential for globalization and proposes an interesting approach to power struggles in an age of inter-jurisdictional technology and a highly concentrated digital content market. This chapter analyses the digital constitutionalism framework from a Latin American point of view, highlighting certain historical differences as well as unique distinctions that could positively inform its regional relevance and future development.
